ACCEPTANCE OF TERMS AND CONDITIONS

By initiating contact with San Francisco Suicide Prevention’s HIV Textline program you are agreeing to all listed terms and conditions, and are certifying knowledge to the service’s privacy policy. If you have further questions regarding use of this service, please contact [email protected] You may opt out of use of the service at any time by texting “END” to the service number.

From time to time, we may use website visitor information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will post the policy changes to our Web site to notify you of these changes and provide you with the ability to opt out of these new uses. If you are concerned about how your information is used, you should check back at our website periodically.

RISKS OF USE

The user of HIV Textline assumes all risk for use. San Francisco Suicide Prevention does not assume responsibility for any actions taken as a result of use of HIV Textline. Counselors answering queries on HIV Textline are not trained medical professionals, and not operating as such. HIV Textline is not considered a replacement or proxy for professional medical care.

Access to the service is limited by counselor availability. There is no maximum wait time until a user will receive a response from a counselor. In the case of crisis or emergency, please call 911.

PROHIBITED USES OF SERVICE

Under specific circumstances users will be restricted from access to HIV Textline. This occurs after initiation of pre-specified unapproved uses, including:

  • Anything that may violate local, state, federal or international laws
  • Abuse or harassment of service providers
  • Abuse or harassment of third parties
  • Exploitation or abuse of minors, elders, or dependent adults
  • Any interference with the successful operation of the program, including but not limited to excessive contact, spamming or flooding the service

LIMITS OF USE

Every user of the HIV Textline is permitted up to one conversation per day, the length of the conversation to be determined by HIV Textline’s counselors. When an HIV Textline counselor chooses to end the conversation, no contact will be responded to until the following calendar day in Pacific Standard Time.

PRIVACY POLICY

Your privacy is important to us. To better protect your privacy we provide this notice explaining our information practices and the choices you can make about the way your information is collected and used.

CONFIDENTIALITY

It is the intent of this organization to support the offer of confidential communication. San Francisco Suicide Prevention does not release or sell the names and addresses of those who contact any of our services.

In general, records will remain confidential, with the following exceptions:

  • when a direct and tangible threat is present, and the texter or other parties may be endangered,
  • when the provisions of existing contracts, laws or regulations require disclosure,
  • when other circumstances, as determined by the Executive Director, make disclosure the most appropriate choice.
  • California law permits the release of confidential information in situations where serious danger to a foreseeable victim is present and where our volunteers suspect child abuse or dependent adult/elder abuse.
  • The Executive Director and/or Clinical Director is authorized to take such steps as they deem reasonable and necessary to protect the confidentiality of records.

We are aware that this policy and our efforts to support it may not always shield the privacy of records.

THE INFORMATION WE COLLECT

This notice applies to all information collected or submitted on San Francisco Suicide Prevention’s HIV Text program.

We collect information volunteered by the consumer, such as name, demographics, and evaluation material. Every contact to our texting program is logged with an attached phone number. All of this material is covered by HIPAA laws and will not be released outside of the circumstances named above.

THE WAY WE USE INFORMATION:

We collect basic demographic information as provided in order to accurately assess use and needs of the service. This information is only used in aggregate form for quality control and funding reports.

Individual information is collected only for clinical purposes, so that our service can best provide consistent and effective care that reflects our agency mission. Provided names, demographic information, phone number, themes and narrative details are documented as part of case history as protected patient information.

OUR COMMITMENT TO DATA SECURITY

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
